Terms and Conditions
Promoter: Nike Australia Pty Ltd (ABN 99 055 141 743), 161 Collins St, Melbourne 3000.
Promotion Period: 12.01am (AEDT) on 01/01/19 to 11.59pm (AEST) on 31/05/19
Promotion elements: There are two elements to this promotion:
Rewards for Few: a game of skill; and Hood to Coast Relay Draw: a game of chance.
Who can participate?: Rewards for Few: Only Australian residents who are aged 18 or over.
Hood to Coast Relay Draw: Only Victorian residents who:
(a) are aged 18 or over;
(b) can take the prize between 21/08/19 and 25/08/19 (inclusive) to coincide with the Hood to Coast Relay 2019;
(c) have a valid passport with a minimum of 12 months validity from 22/08/19;
(d) are eligible for, and obtain, a US tourist visa; and
(e) upon request by the Promoter, sign a declaration and provide a current and valid Australian National Police Check (or apply for an Australian National Police Check at the time requested by the Promoter) to confirm they do not have a criminal background. See paragraph 10 for further details.
Who can't participate?: Directors, officers, management and employees (and their immediate families) of:
(a) the Promoter; and
(b) the agencies, companies or participating premises associated with this promotion.
Instructions: To participate, you must:
(c) if you haven't already done so, download and install the Nike+ Run Club application (N+RC App) on your mobile device. Download, installation and use of the N+RC App are subject to the terms and conditions applicable to the N+RC App;
(d) follow the instructions to sign up for the Go More, Get More challenge (Challenge); and
(e) participate in the Challenge in accordance with the instructions and details provided by the Promoter on the N+RC App.
The Challenge is comprised of 5 targets, each relating to a calendar month with a kilometre distance target for that month.
Rewards for Few
How are winners determined and what can I win? At the end of each calendar month of the Promotion Period, a judging panel appointed by the Promoter will review participants and their participation in the Challenge target that month. The judging panel will select, in their absolute discretion based on, among other things, brand suitability and commercial reasons a certain number of participants to win a "Rewards for Few" prize. The number of winners per month (AEDT/AEST, as applicable), and the prize per month, is as follows:
- January: 10 winners, each receiving a pair of Nike Epic React II shoes valued at $220 each;
- February: 20 winners, each receiving a pair of Nike Odyssey React II shoes valued at $180 each;
- March: 10 winners, each receiving a pair of Nike Epic React II shoes valued at $220 each;
- April: 30 winners, each receiving a pair of Nike Free 2.0 shoes valued at $180 each; and
- May: 10 winners, each receiving a pair of Nike React Phantom shoes valued at $220 each.
Shoes will be provided to each winner in the size specified by the winner.
Chance plays no part in how the Rewards for Few winners will be selected.
All judging decisions are as determined by the Promoter, in its absolute discretion.
Rewards for Few winners will be notified via the N+RC App.
Unclaimed Rewards for Few prize/s: Prizes must be claimed/collected by the time/date specified and in the method specified by the Promoter.
If a participant does not claim/collect their prize as specified, it will be forfeited and an alternate recipient will not be determined.
Hood to Coast Relay Draw
How are winners determined? To receive an entry into the Hood to Coast Relay Draw, you must successfully complete all 5 targets in the Challenge (and record your completion) in accordance with the instructions and details provided by the Promoter on the N+RC App. You can receive a maximum of 1 entry into the Hood to Coast Relay Draw.
Only Victorian residents can receive an entry into the Hood to Coast Relay Draw.
Hood to Coast Relay Draw entrants will be entered into a draw. The draw will include Hood to Coast Relay Draw entries from this promotion, as well as selected N+RC App users in Japan, Mexico, Brazil and Korea (Geo Region). Entry for entrants in Japan, Mexico, Brazil and Korea will be governed by separate terms and conditions.
There will be 1 draw conducted. Thedraw will be held at 9am (Pacific USA Time) on 03/06/19 (which is 7pm (AEST) on 03/06/19) at Nike World Headquarters, 1 Bowerman Drive, Beaverton OR, USA 97006.
The first 3 valid Geo Region entries drawn randomly in the draw will win a prize
Skill plays no part in how the Hood to Coast Relay Draw winners are determined.
The Promoter may arrange to draw additional reserve entries in the draw and record them in order, in case a winning entry/entrant is deemed invalid or a prize is unclaimed (Reserve Entrants).
What can I win?: There are 3 Hood to Coast Relay Draw prizes available in the Geo Region.
The prize is a trip for the winner to Portland, Oregon, USA from 21/08/19 to 25/08/19 (inclusive)to attend and participate in Hood to Coast Relay 2019 valued for Victorian residents at up to $9,000 AUD. See "Travel prize" section below for further prize details.
Travel prize: If you win a prize, your prize will be a trip for you to Portland, Oregon, USA from 21/08/19 to 25/08/19 (inclusive)which includes the following:
(f) return economy airfare (including airfare taxes) from Melbourne, Australia to Portland, Oregon and return transfers between Portland, Oregon airport and the accommodation;
(g) accommodation in a minimum 4 starhotel (as determined by the Promoter) for the duration of the trip (excluding when you are participating in the Hood to Coast Relay 2019);
(h) a place on a team in the Hood to Coast Relay 2019 on 23-24/08/19; and
(i) a guided tour of the Nike world headquarters in Portland, Oregon.
Entry and participation in the Hood to Coast Relay 2019 is subject to the additional terms and conditions imposed by the event organiser.

How and when will the winner/s be informed?: Hood to Coast Relay Draw winner/s will be notified in writing via the N+RC App within two days of determination, and, if they are a Victorian resident, will have their name and state/territory of residence published via the N+RC Appfor a period of 28 days.
Unclaimed Hood to Coast Relay Draw prize/s: Prize claim date: 5pm (Pacific USA Time) on 5/06/19
Unclaimed prize determination: 5pm (Pacific USA Time) on 7/06/19 at the same location as the original draw.
If a prize has not been accepted or claimed by a Victorian resident winner by the prize claim date above or if, after making all reasonable attempts, the Promoter can't contact a Victorian resident winner (or a Victorian resident winner does not contact the Promoter) by the prize claim date above, the relevant entry/ies will be discarded and the Promoter will re-award the relevant prize/s to Reserve Entrant/s and/or carry out an unclaimed prize draw at the date, time and place stated above to randomly distribute the prize/s amongst valid entrants. Any winner/s will be notified in writing via the N+RC App within two days of determination, and, if they are a Victorian resident, will have their name and state/territory of residence published via the N+RC Appfor a period of 28 days.
Unclaimed prize winners will have until the time and date specified in their winner notification to claim their prize, after which time a further re-draw will be conducted, until the prize is claimed.
Collection and use of your personal information: If you are a winner, you must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation. You consent to the Promoter using your name and image in any promotional or advertising activity.
The Promoter may collect your personal information directly or through its agents or contractors. Entry into the competition/acceptance of a prize is conditional upon you providing the requested information and by entering this competition and/or accepting a prize you consent to the use of your personal information as described below. The Promoter will use your personal information to conduct the competition. The Promoter may disclose your personal information to its related companies, agents and contractors to assist in conducting this competition, communicating with you or storing data. This may include disclosures to organisations outside Australia including in the United States. The Promoter’s Privacy Policy (see https://agreementservice.svs.nike.com/au/en_gb/rest/agreement?agreementType=privacyPolicy&uxId=com.nike.unite&country=AU&language=en&requestType=redirect) includes information about:
(j) how to seek access to the personal information the Promoter holds about you and seek correction of the information; and
how to complain about a privacy breach and how the Promoter will deal with such a complaint.
1. These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about prizes and how to enter forms part of these Terms and Conditions. By entering, you accept these Terms and Conditions.
Entry
2. Participation in the Challenge must take place in accordance with the instructions specified on the N+RC App, and will be deemed to be completed only when received by the Promoter. The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases/N+RC App accounts, you may be disqualified. In respect of mobile phone/N+RC App accounts and without limiting any other term of these Terms and Conditions, if there is a dispute about who the prize should be awarded to, the Promoter reserves the right to determine who will be awarded the prize.
Prizes
3. Prize/s and all elements of prize/s must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable. Prize/s are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including, as relevant:
(a) validity period/s;
(b) booking and availability of flights, accommodation and events;
(c) conditions of travel and conditions of entry into any event venues (including behaviour requirements and applicable dress codes);
(d) conditions of ticket validity and any restrictions on ticket on-sale or transfer;
(e) travel dates and specified travel exclusion periods;
(f) any additional fees (payable by you) relating to changes made by you to a travel/event prize after it has been booked;
(g) the requirement to obtain all necessary documents to travel to the USA, including a current and valid passport with a minimum of 12 months validity from 22/08/19 and a US tourist visa; and
(h) a requirement to present your credit card when checking in to accommodation.
4. You are responsible for all other unspecified costs related to the prize, including meals, transport, insurance (including excesses), in-room charges, additional taxes, travel visas, etc. Event tickets can only be used once and will be deemed invalid if copied. The Promoter does not control entry to the relevant event location. The winner/s must keep their tickets safe and the Promoter will not replace lost or stolen tickets.
5. Where relevant, the Promoter accepts no responsibility if one or more of the events or activities awarded as part of the prize areabandoned, called off or postponed for any reason. In that case you forfeit your entitlement to that event/activity. Unless otherwise specified by the Promoter, you will not be given cash or any alternative prize as a substitute for this altered prize element.
General
6. Any failure by you to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier(s).
7. For event-based/travel prizes, you accept that some aspects of the prize may be inherently risky and that the prize may involve dangerous activities.
8. If specified, in order to participate in the activity/activities awarded as part of the prize, you must comply with any applicable conditions (e.g. height, weight, health and fitness requirements). You must ensure that you are healthy and fit enough to participate in the Challenge and take the prize. You must follow all requirements of the people responsible for managing the relevant activity/ies.
9. You must, if required by the Promoter, sign disclaimer and release forms provided by the Promoter in favour of the Promoter and other parties before taking the prize. If you do not sign, your entry will be deemed invalid and you will lose any entitlement to a prize.
10. If you are a winner, you may be required to upon request from the Promoter, provide the Promoter with a valid and current Australian National Police Check that confirms that you do not have a criminal background. If you do not have a valid Australian National Police Check, you will be required to obtain one.
11. If you are a winner, you grant the Promoter and any of its related entities or the agencies or companies associated with this competition a perpetual, worldwide, irrevocable licence to record you, including, without limitation, any aspect of your participation in the competition and attendance at the Hood to Coast Relay 2019 and any related activities, for use in any and all manner or media as the Promoter sees fit without restriction, including the unlimited right to copy, publish, exhibit or use such recording or any part thereof in any manner including, without limitation, in any promotional or advertising activity relating to the competition and the Hood to Coast Relay 2019, and/or for the purposes of marketing and promoting the Promoter's goods and services. You waive any claim for payment for such use.
12. If you or your entry are deemed by the Promoter to breach these Terms and Conditions including if the prize is on set dates and you are unable to take the prize on the relevant date/s, your entry (or at the Promoter's discretion, all of your entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
13. You must not:
(a) tamper with the entry process;
(b) engage in any conduct that may jeopardise the fair and proper conduct of the competition;
(c) act in a disruptive, annoying, threatening, abusive or harassing manner;
(d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;
(e) breach any law; or
(f) behave in a way that is otherwise inappropriate.
14. If you, in the opinion of the Promoter (and/or a medical professional, as relevant to the circumstances), are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Promoter or any of its related entities or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate, the Promoter may cancel the prize or restrict you from participating in any elements of the prize, at its discretion.
15. The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted including failure of any third parties to forward entry forms for inclusion in the draw, where relevant.
16. The Promoter’s decision in connection with all aspects of this competition is final.
17. Prizes cannot be transferred or exchanged nor redeemed for cash. Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value. You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value.
18. If publication of winners' details will take place, by entering, you request that your full address not be published.
19. If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants.
20. The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
Liability
21. Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
22. Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury(including allergies, skin conditions or other reactions, as relevant),illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
23. Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prizes. Unless otherwise specified, prizes will only be delivered to addresses in Australia.
24. This competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter. You provide your information to the Promoter and not to any social media platform. You completely release any relevant social media platforms from any and all liability.
