NIKE INNOVATION PRIVACY POLICY 

Effective Date: April 25, 2022

This policy only applies to the collection and processing of personal data by Nike Inc. (located at Bowerman Drive 1, Beaverton, OR 97005, USA) on or through the Nike Innovation website or mobile application (hereafter: the "Platform"). Other Nike products and services are governed by either the Nike Privacy Policy available on www.nike.com or by the provided privacy policy specific to that product or service. 

COLLECTING PERSONAL DATA

We collect information about you from different sources and in various ways when you use the Platform or engage in research with Nike facilitated through the Platform, including information you provide directly and information we collect automatically.   

Information you provide directly in the Platform. The Platform enables you to create a Nike Innovation profile using your Nike Member Account log-in and basic profile information as noted during the onboarding process. We also ask you for certain personal data to help us determine eligibility and select participants for research opportunities and to communicate with you about participating in research with Nike. If you are selected, you will be provided separate notice and we will seek your consent to collect additional information as part of the particular research experience you are participating in (see more about our processing of that data through the Platform below). 

The personal data we ask you to submit will include optional survey questions and may include your: 

  • Contact details including name, email, and telephone number;
  • Login and account information, including email and password; 
  • Profile identifiers such as screen name and avatar; 
  • Personal details including date of birth, gender, and demographic information such as race and ethnicity;
  • Physical characteristics including weight, height, and body measurements (such as shoe/foot measurements or apparel size);
  • Your affiliation with Nike, if any; and
  • Fitness activity data such as the sports you participate in, levels of play, and frequency and intensity of your workouts.

Information we collect automatically through the Platform. When you use the Platform, we collect some information automatically. For example:

  • Identifiers and device information. When you visit the Platform, our web servers automatically log your Internet Protocol (IP) address and information about your device, including device identifiers (such as MAC address); device type; and your device’s operating system, browser, and other software including type, version, language, settings, and configuration. As further described in the Cookies and Similar Technologies section below, our websites and online services store and retrieve cookie identifiers, mobile IDs, and other data.
  • Usage data. We automatically log your activity on the Platform, including the URL of the website from which you came to the Platform, pages you viewed, access times, and other details about your actions on the Platform.

Information we create or generate. We may infer new information from other data we collect, including using automated means to generate information about your likely characteristics (“inferences”).

Information we collect during research facilitated through the Platform. If you are selected to participate in a research opportunity, you will be provided with a separate notice detailing the data collection and processing acitivites for that opportunity and be required to consent before participating. For your convenience, we may provide you with data, insights or reports from those research opportunities through the Platform. For example, if you participate in an assessment where a written report is generated, that report may be made accessible to you on the Platform so you may access it at your convenience. Any such additional information will be stored and processed as outlined in this policy.  

COOKIES AND SIMILAR TECHNOLOGIES  

We and our service providers use cookies and similar technologies to operate the Platform, including the automatic collection of information as described above. The data collected through cookies includes: (i) IP address; (ii) unique cookie identifier, cookie information and information on whether your device has software to access certain features; (iii) unique device identifier and device type; (iv) domain, browser type and language; (v) operating system and system settings; (vi) country and time zone; (vii) information about your interaction with our Platform such as click behavior, and indicated preferences; and (viii) access times and referring URLs. 

Cookies used on the Platform are generally for two purposes:

  • Functional. These cookies are required to enable basic functionality of the Platform, such as your ability to sign in to the Platform. 
  • Performance. These cookies collect information that allows us to improve platform functionality and your experience on the platform by tracking usage. 

We do not use cookies on this Platform for advertising purposes.

You can choose to have your device or browser limit or disable the use of cookies. You can do this through your browser settings on each browser and device that you use. Each browser is different, so look at your browser Help menu to learn the correct way to modify your cookies. If you turn cookies off, you may not have access to features that make the Platform more efficient and some of the features of the Platform may not function properly.  

HOW WE USE YOUR PERSONAL DATA

We process the personal data we collect on the Platform to operate the Platform and to carry out the purposes for which you provided the data, such as selecting individuals to participate in research and communicating with you regarding research opportunities and/or the research you have chosen to participate in. If you do participate in research facilitated through the Platform, we may also process the personal data collected during that research to make it available to you through the Platform as appropriate. 

In addition, we may process your personal data in other ways such as:

  • Developing, manufacturing and marketing Nike products and services; 
  • Creating, developing or exploring, and modifying or improving Nike products and services (including digitally-enabled services);
  • Furthering research related to human performance; or
  • Preventing or detecting fraud or abuses of our Platform.

LEGAL GROUNDS

To process your personal data, we rely on certain legal grounds, depending on how you interact with our Platform: 

  • When you use our Platform, we need your personal data to fulfill our agreement with you. 
  • When and if you participate in research, we rely on your consent for processing your personal data.
  • We also rely on other legal grounds, such as our legitimate interests as a business, in order to protect our services, maintain a trusted environment, communicating with you about the research and improving our services. In other cases, we may be required to process your personal data to comply with a legal obligation.

WHEN WE SHARE PERSONAL DATA

The personal data we obtain through the Platform will be shared with service providers to enable them to carry out services or other tasks on our behalf (e.g. hosting and platform providers, providers that analyze research data on our behalf, or email communication providers). These service providers process your personal data only on our behalf for the purposes mentioned in this Policy. 

We may also transfer personal data we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, spin-off, dissolution or liquidation). 

We may disclose specific information upon governmental request, in response to a court order, when required by law or to protect our or others' rights, property or safety. We may share information to prevent illegal uses of the Platform or violations of the applicable Terms of Use, or defend ourselves against third party claims. 

We do not sell your personal data. And we do not provide your personal data to agencies or outside companies for marketing purposes.

KIDS

This Platform is intended for adult users and you must be over the age of 18 to register. 

CONTROL OF YOUR PERSONAL DATA AND YOUR RIGHTS

You have certain rights in relation to your personal data. This includes the right to request: (i) access to your personal data; (ii) an electronic copy of your personal data (data portability); (iii) correction of your personal data if it is incomplete or inaccurate; (iv) deletion of your personal data in certain circumstances provided by applicable law; (v) restriction the use of your personal data in certain circumstances provided by law, such as while we consider another request that you have submitted; (vi) objection to the processing of your personal data on grounds relating to your particular situation; or (vii) withdrawal your consent, if you have previously consented. Finally, you may have a right to not be discriminated against for exercising these rights. Note that these rights are not absolute, and there may be exceptions that apply to specific requests to exercise them. You may also lodge a complaint with the relevant supervisory authority in the country in which you reside.

We will verify your request either through a message sent to the email address associated with your account (so you must have access to this email account) or by asking you to provide information matching the information that we have for you within our systems. You or your authorized agent may request to exercise your rights. Before we can act on a request from your authorized agent, we may require verification of your identity and proof from the authorized agent that they can act on your behalf.

CONFIDENTIALITY AND SECURITY 

The Platform uses a range of security technologies and procedures to protect your personal data against unauthorized access, use and disclosure. The personal data that the Platform gathers is stored in a secure environment that is inaccessible to the public. Despite our efforts, no website, mobile application, database or system is completely secure or “hacker proof.” You can help keep your data safe by taking reasonable steps to protect your personal information against unauthorized disclosure or misuse. 

STORAGE AND RETENTION OF YOUR PERSONAL DATA 

The personal data we collect via the Platform will be stored in the USA and other countries. Some of the data recipients with whom we share your personal data may be located in countries other than the country in which your personal data originally was collected. The laws in those countries may not provide the same level of data protection compared to the country in which you initially provided your data. Nevertheless, when we transfer your personal data to other countries, we will protect that personal data in accordance with this policy and in compliance with applicable law.     

We retain your personal data for as long as necessary to fulfill the purposes described in this policy, unless otherwise required or permitted by law. 

LINKS TO OTHER WEBSITES

The Platform may provide links to other websites for your convenience and information. These websites may operate independently from us and may have their own privacy notices or policies, which we strongly suggest you review.  To the extent any linked websites are not owned or controlled by us, we are not responsible for their content, any use of the websites, or the privacy practices of the websites.

CHANGES TO OUR PRIVACY POLICY

If we decide to change our privacy policy, we will post the changed policy on the Platform. You are advised to regularly check whether our privacy policy has changed. If we materially change the way in which we process your personal data, we will provide you with prior notice, or where legally required, request your consent or ensure that there is another legal basis for such processing, prior to implementing such changes.
