Privacy Policy

Nike is responsible for the processing of your personal data obtained on this website (hereafter: the "Website").

COLLECTING PERSONAL DATA

We ask you for certain personal data to provide you with the products and services in support of the research study you are participating in, as may be further described in the Informed Consent for the particular reseach study you are participating in.

This personal data includes your:

  • Contact details including name, email, telephone number;
  • Login and account information, including email and password;
  • Personal details including gender and date of birth;
  • Images, photos and videos;
  • Physical characteristics including weight, height, and body measurements (such as estimated stride and shoe/foot measurements or apparel size);
  • Fitness activity data provided by you or generated through our Platform (time, duration, distance, location, calorie count, pace/stride)
  • Post workout surveys about things such as intensity, duration, and overall rating of the prescribed workout

PROCESSING PERSONAL DATA

When you visit the Website, we collect and process personal data that you submit or that we may ask you for.  We will process this personal data and any subsequent personal data collected for the purpose for which you have specifically submitted them, such as creating your account profile, communicating research study related information, or analyzing your fitness activity data related to the research.

In addition, we may process your personal data in other ways such as:

  • Developing, manufacturing and marketing Nike products and services;
  • Creating and modifying or improving Nike products and services;
  • Furthering research related to human performance;
  • Preventing or detecting fraud or abuses of our Website;

When you visit and interact with the Website, certain data is collected from your device through the use of cookies. The data collected through cookies includes: (i) the visited webpages, (ii) date, time and duration of the visit, and (iii) unique device identifier and device type (desktop, tablet or smartphone).

There are generally two categories of cookies used on the Website:

  • Analytical cookies that are used to collect information about the date and time of your visit, the duration of your visit and the pages you visit. This information is used to better understand the use of the Website and to improve the Website.
  • Functional cookies that are used to collect information about the type of device you are using to visit the Website. This information is strictly necessary to offer you the basic functionality of the Website. 

You can choose to have your device warn you each time a cookie is being sent, or you can choose to turn off cookies. You can do this through your browser settings on each browser and device that you use. Each browser is different, so look at your browser Help menu to learn the correct way to modify your cookies. If you turn cookies off, you may not have access to features that make the Website more efficient and some of the features of the Website may not function properly.

SHARING PERSONAL DATA

The personal data we obtain through the Website will be shared with third parties to enable them to carry out services or other tasks on our behalf (e.g. hosting and platform providers or providers that analyze research data on our behalf). These third parties process your personal data only on our behalf for the purposes mentioned in this Policy.

We may disclose specific information upon governmental request, in response to a court order, when required by law or to protect our or others' rights, property or safety. We may share information to prevent illegal uses of the Website or violations of the applicable Terms of Use, or defend ourselves against third party claims. We do not provide your personal data to agencies or outside companies for marketing purposes.

YOUR PERSONAL DATA RIGHTS

The personal data we collect during the research study will be stored in the USA and other countries. Some of the data recipients with whom we share your personal data may be located in countries other than the country in which your personal data originally was collected. The laws in those countries may not provide the same level of data protection compared to the country in which you initially provided your data. Nevertheless, when we transfer your personal data to recipients in other countries, including the USA, we will protect that personal data in compliance with applicable law. We take measures to comply with applicable legal requirements for the transfer of personal data to recipients in countries outside of the EEA or Switzerland that do not provide an adequate level of data protection. We use a variety of measures to ensure that your personal data transferred to these countries receives adequate protection in accordance with data protection rules; this includes signing the EU Standard Contractual Clauses, or verifying the recipient has adopted Binding Corporate Rules or adheres to the EU-US and Swiss-US Privacy Shield Framework. Where personal data is transferred within Nike, we use an intragroup data transfer agreement.          

You also have certain rights in relation to your personal data. This includes the right to request: (i) access to your personal data; (ii) an electronic copy of your personal data (portability); (iii) correction of your personal data if it is incomplete or inaccurate; or (iv) deletion or restriction of your personal data in certain circumstances provided by applicable law. These rights are not absolute. You also have the right to withdraw your consent for Nike to use your personal data at any time.

CONFIDENTIALITY AND PROTECTION

The Website uses a range of security technologies and procedures to protect your personal data against unauthorized access, use and disclosure. The personal data that the Website gathers is stored in a secure environment that is inaccessible to the public.

RETENTION OF YOUR PERSONAL DATA 

We retain your personal data for as long as necessary to fulfil the purposes described in this policy, unless otherwise required or permitted by law. 

LINKS TO OTHER WEBSITES 

The Website may provide links to other websites for your convenience and information.  These websites may operate independently from us and may have their own privacy notices or policies, which we strongly suggest you review.  To the extent any linked websites are not owned or controlled by us, we are not responsible for their content, any use of the websites, or the privacy practices of the websites.

CHANGES TO OUR PRIVACY POLICY

If we decide to change our privacy policy, we will post the changed policy on the Website. You are advised to regularly check whether our privacy policy has changed. If we materially change the way in which we process your personal data, we will provide you with prior notice, or where legally required, request your consent or ensure that there is another legal basis for such processing, prior to implementing such changes.
