NIKE’S GO MORE, GET MORE CHALLENGE
Terms & Conditions
These are the official Terms and Conditions ("T&Cs”) of NIKE’s GO MORE, GET MORE CHALLENGE (the "Challenge”) and may be amended or updated by NIKE at any time. By entering the Challenge, individual entrants accept and agree to be bound by these T&Cs. The current version of the T&Cs shall be made available on https://www.nike.com/events-registration/event?id=112297.
1. WHO IS SPONSORING THE CHALLENGE? The Challenge is sponsored by Nike European Operations Netherlands BV whose registered office is located at Colosseum 1, 1213NL, Hilversum, The Netherlands ("NIKE”).
NIKE reserves the right to modify or cancel this Challenge at any time and, in the event of cancellation, substitute another in its place. The Challenge is in no way sponsored, endorsed or administered by, or associated with Apple, Inc., Facebook, Instagram or Twitter.
2. NO PURCHASE IS REQUIRED TO ENTER THE CHALLENGE. No purchase is required to enter the Challenge.
3. WHO IS ELIGIBLE? The Challenge is open only to individuals aged 18 and over at the time of entry who are residents of, France, Germany, the Netherlands, Spain, and the United Kingdom and who are registered NIKEPlus members (together the “Entrants” and each an “Entrant”). If you are not already a NIKEPlus member, you can join for free by visiting www.nike.com.
Employees of NIKE EUROPEAN OPERATIONS NETHERLANDS B.V., NIKE USA, Inc. and its parent company, NIKE, Inc., their subsidiaries and affiliates or of other companies associated with the promotion of the Challenge, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible.
4. HOW DO I ENTER? The Challenge starts on 01/01/2019 at 00:00 CET/GMT, and ends on 31/05/2019, at 23:59 CET/GMT (the "Challenge Period”). During the Challenge Period there will be five (5) monthly challenges whereby Entrants will be challenged to run a certain distance (the “Monthly Challenge”). Each Monthly Challenge will start on or about 12:00 a.m. GMT on the first day of the calendar month and ending at 11:59 p.m. GMT on the last day of the calendar month (the “Entry Period”). Entrants must complete each Monthly Challenge within the Entry Period. The Monthly Challenge can be achieved either through one run or through a series of separate runs provided that each individual run is “completed” in the App. Entries submitted before or after the Entry Period will be disqualified.
During the Entry Period:
- Download the NIKEPIus Run Club App (the “App”) onto your device (if the Entrant does not already have the App);
- Make sure your workout information sharing setting is turned "on” within the App;
- Accept the Monthly Challenge by completing the sign up form displayed within the App;
- Accept the Terms and Conditions of the Monthly Challenge which will be hyperlinked on the sign up page; and
- Complete the Monthly Challenge on the App during the Entry Period.
If you complete all five (5) Monthly Challenges you can enter into a prize draw to win a Grand Prize (the “Grand Prize Draw”), to enter into the Grand Prize Draw:
- Complete the five (5) Monthly Challenges; and
- Complete the sign up form via the NET available at the following link https://www.nike.com/events-registration/event?id=112297.
There is a limit of one (1) entry per Entrant for each Monthly Challenge and the Grand Prize Draw. Subsequent entries will be void. NIKE has the sole discretion to determine whether an entry is eligible. Any entry that violates these T&Cs or is otherwise objectionable (as determined solely by NIKE), will not be considered and will be disqualified. Incomplete or ineligible entries will be invalid.
5. HOW WILL WINNERS BE SELECTED?
Monthly Prizes
- By completing the Monthly Challenge you will automatically win the following prize one (1) digital NRC Badge automatically delivered to your mobile device via the App.
- By completing the Monthly Challenge you will also be automatically entered to be one of up to 100 randomly selected people to receive one (1) Nike product to be outlined each month via the App. On or after the third day of the following month after the end of each Entry Period, Nike will select up to one hundred (100) potential winners in a random drawing of all entries received. The odds of winning depend on the total number of eligible entries received. The potential winners will receive a message in the App and a push notification (if enabled on the Entrant’s device) with details of how to access the prize within seven (7) days of the drawing. If a potential winner declines to accept the prize or has violated any of these Terms and Conditions, then an alternate Entrant may be selected, at Nike’s discretion and if time permits, in his/her place in a random drawing of remaining eligible entries. If an alternate Entrant is selected, only two (2) alternate drawings will be held, after which the prize will remain un-awarded.
Grand Prize
- On or about 06/06/2019 to 13/06/2019, NIKE will select a total of three (3) potential winners from three (3) separate random drawings comprised of all entries received (one drawing with one winner per day). The odds of winning depend on the total number of eligible entries received. The potential winners will receive a message in the App and a push notification (if enabled on the Entrant’s device) with details of how to access the prize within three (3) days of the drawing. If a potential winner declines to accept the prize, has violated any of these Terms and Conditions, or fails to sign and return the required documents within the required time period, then an alternate Entrant may be selected, at Nike’s discretion and if time permits, in his/her place in a random drawing of remaining eligible entries. If an alternate Entrant is selected, only two (2) alternate drawings will be held, after which the prize will remain un-awarded.
All potential winners are subject to verification by Nike, whose decisions are final and binding in all matters related to the Challenge. An Entrant is not a winner of any prize unless and until Entrant’s eligibility and compliance with these Terms and Conditions have been verified and Entrant has been notified that verification is complete. Nike will not accept screen shots or other evidence of winning in lieu of its validation process. Any entry submitted after the system has been compromised or failed for any reason is deemed a defective entry and is void and will not be honoured.
6. WHAT DO I GET FOR COMPLETING THE CHALLENGE?
Monthly Prizes:
The following prizes will be available to Entrants who complete the Monthly Challenge:
- Each Entrant will receive (1) digital NRC Badge. Total approximate Retail Value (“ARV”): [€0]; and
- Up to 100 x (1) Nike product. ARV: [€150].
Select Monthly Prizes:
The following prizes will be available to Entrants who complete the Monthly Challenge:
- January – 50 x (1) pair of men’s NIKE Epic React Flyknit trainers and 50 x (1) pair of women’s Epic React Flyknit trainers. ARV not to exceed €150;
- February – 50 x (1) pair of men’s NIKE Artist Pack apparel item and 50 x (1) pair of women’s NIKE Artist Pack apparel item. ARV not to exceed €150;
- March – 50 x (1) pair of men’s NIKE Epic React Flyknit trainers and 50 x (1) pair of women’s Epic React Flyknit trainers. ARV not to exceed €150;
- April – 25 x one (1) pair of NIKE Epic React 87 trainers. ARV not to exceed €200;
- May – 10 x one (1) Apple Watch Nike+ Series 4. ARV not to exceed €400.
The Select Monthly Prizes are subject to availability. NIKE reserves the right to substitute, at its discretion, any of the prizes for a Nike product of equivalent ARV if the NIKE products listed above are out of stock.
Grand Prize:
The following prizes will be available for each Entrant who enters the Grand Prize Draw:
- 3x all expenses paid trip to participate in the Hood to Coast relay team from [21/08/2019 – 25/08/2019]. The trip includes: roundtrip economy class airfare ticket to Portland, Oregon, USA, four (4) nights accommodation, four (4) days of meals, transportation, participation on a Hood to Coast relay team and NIKE product. ARV not to exceed $6,500 per person. Winners may (at the winner’s sole cost) invite a guest to join them on the trip and participate in the activities at the winner’s sole cost.
Any prize or product detail not specified above will be determined by NIKE in its sole discretion. The ability to purchase the products is not transferable and must be accepted as awarded. No cash or other substitution may be made. Winners are responsible for any and all other costs and expenses not listed above.
7. PERSONAL DATA PROTECTION. In order to participate in the Challenge, the Entrant will supply personal information about themselves or personal information may be processed by virtue of the Entrant’s participation. This includes the personal data included in this form, in connection with the Entrant’s registration and other personal data processed through the Challenge itself. NIKE will process this personal information for the purposes of administering the Challenge and for the specific purposes described in these T&Cs in accordance with applicable data protection and privacy law. NIKE will transfer Entrant’s personal information to Nike Inc. based in the United States of America and to other Nike Group companies located outside of the European Economic Area and Switzerland.
By participating in the Challenge, each Entrant confirms their consent to the processing and transfer by NIKE of the Entrant’s personal information outside of the European Economic Area and Switzerland. More information on how Entrants’ personal information is processed can be found at NIKE Privacy and Cookie Policy which can be found at https://agreementservice.svs.nike.com/gb/en_gb/rest/agreement?agreementType=privacyPolicy&uxId=com.nike.unite&country=GB&language=en&requestType=redirect. Entrants have a right to access, rectify and delete their personal information processed by NIKE. Entrants may exercise these rights by sending an email to: privacy@nike.com.
8. OTHER TERMS
Unless prohibited by law, the Entrant agrees to allow use of Entrant’s name, voice, place of residence, photograph, and/or likeness for advertising and/or trade and/or any other purpose in any media or format now or hereafter known without further compensation, permission or notification.
In the event that the operation, security, or administration of the Challenge is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, NIKE may, in its sole discretion, either: (a) suspend the Challenge to address the impairment and then resume the Challenge in a manner that best conforms to the spirit of these T&Cs; or (b) determine the Successful Entrants from among the eligible entries received up to the time of the impairment. NIKE reserves the right in its sole discretion to (i) not nominate any Products (if applicable), or (ii) disqualify, any individual it finds to be tampering with the entry process or the operation of the Challenge or to be acting in violation of these T&Cs in an unsportsmanlike, inappropriate, illegal or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Challenge may be a violation of criminal and civil law, and, should such an attempt be made, NIKE reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by NIKE to enforce any term of these T&Cs shall not constitute a waiver of that provision.
By participating in the Challenge, the Entrant agrees to release and hold harmless NIKE, its parent and related companies, and their respective officers, directors, employees, and agents (the "Released Parties”) from and against any claim or cause of action arising out of participation in the Challenge or receipt or use of any Product, including, but not limited to: (a) unauthorized human intervention in the Challenge; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Challenge or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from the Entrant’s participation in the Challenge or receipt or use of any Product. The Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited, to the extent permitted by law, and in no event shall the Released Parties be liable for legal fees. The Entrant waives the right to claim any damages whatsoever.
9. HOW WILL DISPUTES BE HANDLED? These T&Cs and any disputes arising in connection thereto shall be governed by and construed in accordance with the laws of the jurisdiction of the Entrant’s residence. If for any reason, a court of competent jurisdiction finds any provision or portion thereof, to be unenforceable, the remainder of these T&Cs will still be applicable and in full force and effect.
