Launch Terms

  1.        Launch Events

“Launch Events” are conducted by Nike Retail B.V. or any of its Affiliates (as defined below), with its principal place of business at Colosseum 1, 1213 Hilversum, Netherlands or any of its Affiliates (as defined below) (“NIKE, us, our”).  By signing up for a Launch Event, consumers (“you, your, participant”) register for the opportunity to purchase the NIKE footwear or apparel specified for that Launch Event in the Launch invitation (“Applicable Products”).

 

2.         Applicable Terms

These Launch Terms (“Launch Terms”) are made by and between NIKE or any of its Affiliates and you. A NIKE Affiliate shall mean any corporation or other entity that directly, or through one or more intermediaries, controls, is controlled by, or is under common control of NIKE.  (“Affiliate”). Your participation in a Launch Event is subject to the details in the Launch event card or page (“Launch Invitation”), these Launch Terms, NIKE’s {{agreement:termsOfUse:Terms of Use}}, and NIKE’s {{agreement:termsOfSale:Terms of Sale}} where applicable (collectively, “Applicable Terms”). By entering a Launch Event, you agree to be bound by all Applicable Terms. In the event of any conflict between these Launch Terms and the Terms of Use or Terms of Sale, these Launch Terms will prevail.

 

3.         Participation

To participate in a Launch Event, you download the applicable app or visit the applicable website (including but not limited to, NIKE App, SNKRS App, and NIKE.com) (each an “Applicable Channel”), log in to your NIKE account, and follow the instructions to register. There is a limit of one (1) registration per person, per Launch Event. Subsequent registrations will be void. If you don’t have a NIKE Membership, you may create an account during registration. NIKE Membership is free. You must be of legal age for your country/region with respect to entering an event of this nature. 

 

The Launch Event Start Time or Entry Period (as applicable) is provided within the specific Launch Invitation.

 

4.         Privacy Policy. 

Our {{agreement:privacyPolicy:Privacy Policy}} describes NIKE’s collection and use of personal information, and applies to personal information collected in connection with your participation and registration in a Launch Event. By registering for a Launch Event, you agree that NIKE may process your personal data in accordance with its Privacy Policy for the purposes of the Launch Event.

 

5.         Selection Process

Selection processes vary by Launch Event and shall be applied as detailed below and in the applicable Launch Invitation. Launch Events (except for The Draw and SNKRS Pass, described separately below) start at the time described in the Applicable Channel (“Start Time”). After the Start Time, NIKE will use an automated process to randomly select participants until Applicable Product is sold out. The likelihood of selection depends on time of entry and the availability of Applicable Product. Applicable Product supplies are limited.

 

You agree that NIKE has made no warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to any eligibility to purchase NIKE product during any Launch Event.

 

The Draw

Launch Events described as “Draw” or “The Draw” in the Applicable Channel shall use the following process. The Draw entry period will start and end at the times described in the Launch Invitation via the Applicable Channel (“Draw Entry Period”). All entries must be submitted before the end of the Draw Entry Period. After the Draw Entry Period, Nike will utilize an automated process to randomly select participants to purchase the Applicable Product. All participants will have an equal chance of selection. The likelihood of selection will depend on the total number of valid entries and the availability of the Applicable Product. Applicable Product supplies are limited.

 

SNKRS Pass

Launch Events described as “SNKRS Pass” are only accessible in the SNKRS App and use the following process. SNKRS Pass entry period will start and end at the times described in the SNKRS App (“Pass Entry Period”). All entries must be submitted before the end of the Pass Entry Period. After the Pass Entry Period, Nike will utilize an automated process to randomly select participants to purchase the Applicable Product. All participants will have an equal chance of selection, and the likelihood of selection will depend on the total number of valid entries and the availability of the Applicable Product. Applicable Product supplies are limited.

 

SNKRS Pass Product Purchase, Collection and Payment Terms

SNKRS Pass require in-store purchase and pickup of the Applicable Product. To register for SNKRS Pass, you must select a pickup location from the available options and confirm your full name, as displayed on your valid photo identification. If you are selected, you will receive a notification confirming the time-period the Applicable Product will be reserved for purchase and pickup. Full payment, valid photo identification, and presentation of your SNKRS Pass QR Code (on your registered device) will all be required to pick up the Applicable Product. If you do not purchase and pick up the Applicable Product within the specified time-period, your reservation will be cancelled, and you will not be charged.

 

Supplemental Processes

When indicated in an applicable Launch Invitation, to manage high volumes of participants, avoid abuse and ensure Launch Event fairness (including mitigation of automated BOTS), NIKE will use proprietary processes to augment certain random selection Launch Events, where selection will remain random, but likelihood of success may be weighted based on factors determined at NIKE’s sole discretion (unless otherwise required by applicable law), including, but not limited to, prior launch entries and prior wins and losses, and site engagement. NIKE reserves the right to change Launch Event processes at any time prior to the start of the Launch Event.

 

6.         Agreement to Purchase.

The price of the Applicable Product shall be displayed on the Launch Invitation. Applicable charges for shipping, taxes, and duties will be calculated based on your address at time of registration. By registering, you agree that if you are selected, NIKE can automatically charge the credit card you entered during registration for the full retail value of the product you selected, plus applicable shipping, handling, duties, and taxes, except for SNKRS Pass Launch Events (described separately above).

 

ApplicableProduct supplies are limited.Your credit card will not be charged unless you are selected.If you are selected, your credit card (or approved payment method) will be charged as soon as your order is shipped from NIKE’s distribution center.

 

Eligibility to buy any Applicable Launch Product is not transferable and must be accepted as awarded.

 

7.            Notification. 

Within twenty-four (24) hours of the end of the registration period, you will receive a notification (via in-App notification, NIKE account inbox, SMS, or email, as determined and indicated by NIKE) letting you know whether you were or were not selected to purchase an Applicable Product.

 

8.         Payment. 

There is a limit of one (1) purchase per person, per Launch Event. All available payment methods will be listed during registration. NIKE does not accept any method of payment other than those listed during registration. Your delivery address may not be changed after your order is submitted.

 

9.         Additional Terms.

The offer to enter any Launch Event is void where prohibited by applicable law. NIKE also reserves the right to prevent any person from participating, as well as to seek damages from that person, if they violate Applicable Terms, attempt to cheat, or engage in any fraudulent behavior. In the event that any person violates any of the Applicable Terms, then NIKE reserves the right to select an alternate participant. Selected participants’ rights may not be sold or transferred. Failure by NIKE to enforce any provision of the Applicable Terms shall not constitute a waiver of that provision.
