لأغراض مستند "إقرار المشارك" هذا، فإن كلمة "الفعالية" تعني أي تدريب لدى نادي NIKE التدريبي والتي يجوز لي حضورها حالياً أو في المستقبل في أي موقع وكافة وسائل المواصلات من وإلى مواقع التدريب لدى نادي NIKE التدريبي وكافة فحوصات المنتجات خلال أي من تدريبات نادي NIKE التدريبي وكافة الأنشطة الأخرى المرتبطة بتلك بتدريبات نادي NIKE التدريبي أو بالمشاركة في تدريبات نادي NIKE التدريبي. ويتم تنظيم الفعالية من قبل نايكي يوروبيان أوبريشن نذرلاندز بي في، وعنوانها المسجل هو كوليسيوم 1، 1213 إن إل، هيلفرسوم، هولندا ("NIKE"). وفي مقابل حصولي على فرصة المشاركة في هذه الفعالية، (والتي أقر بموجبه باستلامها وكفايتها)، فإنني أوافق بموجبه، موافقة غير مشروطة ولا رجوعه فيها، بالأصالة عن نفسي ونيابة عن ورثتي وتركتي وشركات تأميني وخلفائي والمتنازل لهم، على ما يلي:
افتراض المخاطر: لا توجد أية تعهدات من قبل NIKE تجاهي عن مدى ملائمة أو حالة أو سلامة مكان الفعالية وأقر أن المشاركة في الفعالية قد تنطوي على مخاطر أو أخطار قد تؤدي إلى حوادث أو إصابة شخصية وجسدية أو فقدان لممتلكات أو حدوث أضرار للممتلكات. وأؤكد أنني أتمتع بصحة جيدة ولا أعاني من أي حالة طبية أو صحية يمكن أن تشكل خطرًا أو تحد من قدرتي أثناء المشاركة في الفعالية. وأُدرِك وأخذت بعين الاعتبار وقيَّمت طبيعة ونطاق ومدى المخاطر التي قد تنطوي عليها الفعالية، وأتحمل تلك المخاطر طواعية وبحرية. بالإضافة إلى ذلك، أوافق على الامتثال للتعليمات المعقولة التي تصدر عن القائمين على الفعالية أثناء سير الفعالية.
التأمين: إنني أدرك بأن NIKE لا توفر أي تأمين سواء على الحياة أو تأمين طبي ولا تتحمل المسؤولية عن أي مرض أو حادث أو إصابة أو خسارة أو ضرر قد ينشأ عن المشاركة في الفعالية. وأوافق على أنه في حال أصبحت مريضاً أثناء الفعالية أو بعدها وتلقيت الرعاية الطبية أو العلاج على يد الموظفين مزودي الرعاية الطبية في الفعالية، أو على يد أي طبيب أو مستشفى، فإنني أخول أولئك الأشخاص بتقديم بياناتهم (بما فيها بيانات العلاج الطبي الذي أعطوني إياه) إلى NIKE و/أو إلى الغير الذين تخولهم NIKE بتجميع تلك البيانات، مع مراعاة الحفاظ على السرية الطبية المناسبة، وذلك بغية تمكين NIKE من إعداد تقرير عن الحادث والاحتفاظ بذلك التقرير لأغراض الاستخدام الداخلي فقط.
التعويض عن الضرر: إلى الحد الأقصى الذي يسمح به القانون المعمول به، فإنني أوافق بموجبه بلا رجعة ودون قيد أو شرط على عدم الإضرار بشركة NIKE وتعويضها وضمان تعويضها عن وضد أية مطالبات أو مبالغ أو تكاليف أو أضرار أو مصاريف (بما في ذلك الرسوم القانونية المعقولة) تنشأ بسبب أي حادث أو فقد أو تلف ينجم عن حضوري أو مشاركتي في الفعالية.
المسؤولية: لأقصى حد مسموح به بموجب القانون، أوافق على أن يتم إبراء شركة NIKE من أية مسئولية تتعلق بمشاركتي في المسابقة إلا في حالة الإهمال أو سوء التصرف المتعمد.
تسجيل الأفلام ومقاطع الفيديو: أقر وأوافق على حق شركة NIKE وشركاتها الزميلة والتابعة لها وفروعها والمرخص لهم ووكلائها وخلفائها والمتنازل لهم والشركاء التجاريين المرخص لهم من قبل NIKE (يُشار إليهم مجتمعين بـ "مجموعة NIKE") في القيام بتصوير الأفلام أو التصوير الفوتوغرافي أو تسجيل حضوري في الفعالية والأنشطة ذات الصلة وذلك لأغراض NIKE الدعائية أو الترويجية أو التجارية أو الداخلية. وأمنح بموجبه مجموعة NIKE الحق في استخدام أي صورة أو فيديو أو غيرها من الوسائط المسجلة، إلى أقصى مدة تسمح بها القوانين والأنظمة والمعاهدات المعمول بها، لغرض الإعلان أو الترويج أو لأي غرض من الأغراض التجارية الأخرى المتعلقة بترويج الفعالية أو فعاليات NIKE المستقبلية أو في حملات NIKE أو الأنشطة الترويجية الأخرى لشركة NIKE وذلك في جميع أنحاء العالم ودون مقابل. كما أنني أمنح بموجبه شركة NIKE الإذن في نشر اسمي وصورتي وترتيبات ونتائج الفعالية، سواء أثناء الفعالية أو في أي وسيلة إعلامية وبأي شكل من الأشكال المعروفة الآن أو التي تنشأ فيما بعد.
منح الحق في استخدام التعليقات والملاحظات التقييمية والأفكار: إنني أمنح بموجبه شركة NIKE وبشكل دائم الحق في استخدام كافة التعليقات والملاحظات التقييمية والأفكار التي قد قمت بتقديمها لها، وذلك دون إشعار أو مقابل وبدون الحاجة إلى إذن مني ، ولأي أغراض أيًا كانت، بما في ذلك، على سبيل المثال لا الحصر، تطوير وتصنيع وتسويق المنتجات والخدمات وإنشاء وتعديل أو تحسين المنتجات والخدمات.
حق NIKE في رفض المشاركة: أُدرِك وأقر بأن NIKE لها الحق في جميع الأوقات بأن ترفض حضوري أو مشاركتي في أنشطة الفعالية في حال عدم التزامي ببنود هذا الاتفاق أو بتوجيهات موظفي أو ممثلي NIKE أثناء الفعالية.
حماية البيانات الشخصية: من أجل المشاركة في الفعالية يتعين عليك تقديم معلومات شخصية معينة عن نفسك أو تقديم معلومات شخصية قد تتم معالجتها بموجب اشتراكك. وتتضمن تلك المعلومات البيانات الشخصية الواردة في هذه الاستمارة، والتي تتعلق بتسجيلك وغيرها من البيانات الشخصية التي تتم معالجتها من خلال الفعالية ذاتها. ستقوم NIKE بمعالجة هذه المعلومات الشخصية لأغراض إدارة الفعالية وللأغراض المحددة الموضحة في نموذج الإقرار وفقاً للقانون المعمول به بشأن الخصوصية وحماية البيانات. ستقوم NIKE بتحويل بياناتك الشخصية إلى شركة Nike Inc الكائنة في الولايات المتحدة الأمريكية وإلى غيرها من الشركات في مجموعة NIKE والتي تتواجد خارج المنطقة الاقتصادية الأوروبية وسويسرا.

عدم القابلية للتحويل: أُدرِك أن مشاركتي في الفعالية غير قابلة للتحويل للغير ولا يمكن استبدالها بمقابل نقدي.
الصلاحية: إذا ثبت عدم صلاحية أي بند في هذا الاتفاق، جزئيًا أو بالكامل، أو عدم قابليته للتنفيذ لأي سبب من الأسباب، فإن ذلك لا يؤثر على صلاحية البنود المتبقية من هذا الاتفاق، وتظل صالحة وواجبة التنفيذ. ويجب أن يتم استبدال البند الباطل أو الغير قابل للتنفيذ بآخر صالح يشبهه قدر الإمكان من حيث المضمون. ويحل هذا الاتفاق محل أي اتفاق شفهي أو خطي صدر سابقاً فيما يتعلق بالفعالية.
الاختصاص القضائي والتفسير: يخضع ويُفَسَّر هذا الاتفاق وأي نزاع ينشأ بخصوصه للقوانين السارية في الدولة التي يقيم فيها المشارك.
لقد قرأت البنود الواردة أعلاه بتمعن وفهمت محتواها فهماً كاملاً وأوافق طوعاً على ما ورد فيها من شروط.

أولًا. أوافق على جميع بنود هذا الاتفاق؛
ثانيًا. أوافق على إلزام المشارك بالتقيد ببنود هذا الاتفاق،
ثالثًا. أُخوِّل وأسمح لـ NIKE، ووكلائها، والعاملين في الفعالية بتقديم الإسعافات الأولية الطارئة للمشارك ونقله في حالات الطوارئ وإجراء أي معالجة طبية طارئة أخرى يقوم بها الأطباء والمسعفون وغيرهم من المختصين الطبيين (بما في ذلك تجنبًا للشك أي اختبار أو تجارب طبية) في حال وقوع أي حادث أو إصابة للمشارك أثناء الفعالية أو بسببها.
أنا الوالد الذي يملك السلطة الأبوية أو ولي الأمر القانوني للمشارك المذكور أعلاه الذي يقل عمره عن 18 عامًا وقد قرأت البنود الواردة أعلاه بعناية، وفهمت محتواها تمامًا، وأوافق طواعية على هذه الشروط نيابة عن المشارك.

PARTICIPANT RELEASE NIKE TRAINING CLUB (NTC)
PLEASE READ CAREFULLY
For purposes of this “Participant Release” document, “Event” means any NIKE Training Club workout that I may attend now or in the future, at any location, any and all transportation to, from and between any NIKE Training Club workout locations, all product testing at any NIKE Training Club workout, and all other activities related to any NIKE Training Club workout and to my participation in any NIKE Training Club workout. The Event is organized by Nike European Operations Netherlands B.V. whose registered offices are located at Colosseum 1, 1213NL, Hilversum, The Netherlands (“NIKE”). In consideration of the opportunity to participate in the Event, (the receipt and sufficiency of which is hereby acknowledged), I hereby irrevocably and unconditionally for myself, my heirs, estate, insurers, successors and assigns, agree as follows:
ASSUMPTION OF RISK: NIKE has made no representation to me as to the suitability, condition, or safety of the Event venue and I acknowledge that participation in the Event may involve risks and dangers of accidents, personal and bodily injury and property loss or damage. I confirm that I am in good health and have no medical or health condition that could endanger or limit my ability whilst participating in the Event. I understand and have considered and evaluated the nature, scope and extent of the risks involved, and I voluntarily and freely choose to assume these risks. In addition, I agree to comply with the reasonable instructions of the Event leaders during the course of the Event.
INSURANCE: I understand that NIKE does not provide any insurance, whether life or medical or liability, for any illness, accident, injury, loss or damage that may arise in connection with my participation in the Event. I agree that if I become ill during or after an Event and receive medical attention or treatment from the Event medical personnel provider, or any doctor or hospital, I authorize such persons to provide their details (including details of medical treatment given to me) to NIKE and or others authorized by NIKE to collect such information, subject to maintaining appropriate medical confidentiality, to enable NIKE to prepare a report of the incident and retain such report for internal purposes only.
INDEMNITY: To the maximum extent permitted by applicable law, I hereby irrevocably and unconditionally agree to hold harmless, indemnify and reimburse NIKE from and against any claim, sum, costs, damages or expenses (including reasonable legal fees) arising in connection with any accident, loss or damage arising out of my attendance or participation in the Event.
LIABILITY: To the maximum extent permissible under law, I agree that any liability of NIKE relating to my participation in the Contest is excluded except in case of negligence or wilful misconduct.
FILM AND VIDEO RELEASE: I acknowledge and agree that NIKE, its associates, affiliates, subsidiaries, licensees, agents, successors, assigns and commercial partners authorized by NIKE (collectively, “NIKE Group”), may be filming, photographing or otherwise recording my attendance at the Event and any related activities for advertising, promotional, commercial and/or for NIKE internal purposes. I hereby grant the NIKE Group the right to use for the maximum time allowed by the laws, regulations and treaties in force, throughout the world and without any compensation, any photograph, video, image or other recorded media or likeness of me for the purpose of advertising, promotion, or any other commercial purpose in connection with the promotion of the Event or future events, in NIKE campaigns and/or for other NIKE promotional activities. I also hereby grant NIKE permission to display my name, image, Event standings and results, both during the Event and in any media and in any manner now known or hereafter developed.
LICENSE TO USE COMMENTS, FEEDBACK AND IDEAS: I hereby grant to NIKE a perpetual license to use all comments, feedback and ideas I may share with them, without notice, compensation or acknowledgement to me, for any purposes whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving products and services.
NIKE'S RIGHT TO REFUSE ENTRY: I understand and acknowledge that NIKE shall at all times be entitled to refuse my attendance at, and/or my participation in Event activities in the event I do not comply with this agreement or with the directions of NIKE staff or representatives at the Event.
PERSONAL DATA PROTECTION: In order to participate in the Event, you will supply personal information about yourself or personal information may be processed by virtue of your participation. This includes the personal data included in this form, in connection with your registration and other personal data processed through the Event itself. NIKE will process this personal information for the purposes of administering the Event and for the specific purposes described in this consent form in accordance with applicable data protection and privacy law. Nike will transfer your personal information to Nike Inc. based in the United States of American and to other Nike Group companies located outside of the European Economic Area and Switzerland.
By signing below, I hereby consent to the processing and transfer by NIKE of my personal information outside of the European Economic Area and Switzerland. More information on how your personal information is processed can be found at NIKE Privacy and Cookie Policy which can be found at http://help-en-gb.nike.com/app/answers/detail/article/privacy-policy/a_id/16415/p/3897. You have a right to access, rectify and delete personal information processed by NIKE. You may exercise these rights by sending an email to: privacy@nike.com.
NON TRANSFERABLE: I understand that my participation in the Event is non-transferable and is not redeemable for cash.
VALIDITY: If any clause in this agreement is held, in part or in full, to be invalid or unenforceable for any reason, the validity of the remaining clauses of this agreement shall not be affected, and they shall continue to be valid and enforceable. The invalid or unenforceable provision shall be replaced with a valid provision which is as similar as possible in substance to the invalid or unenforceable provision. This form supersedes any oral or written agreement made previously in relation to the Event.
JURISDICTION AND INTERPRETATION: This agreement and any disputes arising in connection thereto shall be governed by and construed in accordance with the laws of the jurisdiction of the participant’s residence.

PARENT/GUARDIAN AGREEMENT
I am the parent who has parental authority or the legal guardian of the above named participant and I agree that the participant may take part in the Event supervised by a suitable NIKE representative. On behalf of the participant, myself, the participant’s parents or guardians, heirs, estate, insurers, assigns and anyone else who may make any claim for or on behalf of the participant, I hereby unconditionally:
I. agree to all of the terms of this agreement; II. agree to cause the participant to comply with the terms of this agreement; and III. authorise and permit NIKE, its agents, and Event personnel to administer emergency first aid to the participant, emergency transportation, and any other emergency medical treatment performed by doctors, paramedics, and other medical personnel (including for the avoidance of doubt any medical test and/or trials) in the event of any accident or injury to the participant that may occur during and/or as a consequence of the Event.
I AM THE PARENT WHO HAS PARENTAL AUTHORITY OR THE LEGAL GUARDIAN OF THE BELOW NAMED PARTICIPANT WHO IS UNDER THE AGE OF 18 AND I HAVE READ THE ABOVE CAREFULLY, FULLY UNDERSTAND ITS CONTENT, AND VOLUNTARILY AGREE TO THESE TERMS ON BEHALF OF THE PARTICIPANT.
