إقرار المشارك بالإعفاء من المسؤولية

نادي NIKE التدريبي(NTC)

PLEASE READ CAREFULLY

يرجى القراءة بعناية

I am aged 18 or over and have not been incapacitated and I wish to participate in the Event (as defined below), or, if the participant (the "Participant") is aged under 18 years old or aged 18 years old or above but incapacitated, I, in my capacity as their legal guardian or parent, am accepting this “Participant Release” on their behalf.

For the purposes of this Participant Release, “Event” means any NIKE Training Club workout that I/the Participant may attend now or in the future, at any location, any and all transportation to, from and between any NIKE Training Club workout locations, all product testing at any NIKE Training Club workout, and all other activities related to any NIKE Training Club workout and to my/the Participant’s participation in any NIKE Training Club workout.  In consideration of the opportunity to participate in the Event,  I/the Participant hereby fully, completely, irrevocably and unconditionally agree(s) as follows:

إنني أبلغ من العمر 18 عاماً أو أكثر وغير عاجز، وأرغب في المشاركة في الحدث (حسبما هو معرّف أدناه)، أو إذا كان المشارك (ويشار إليه بـ"المشارك") يقل عمره عن 18 سنة أو عمره 18 سنة أو أكثر وإنّما عاجز، فإنني أوافق بصفتي الوصي القانوني أو الوالد/الوالدة على هذا الإقرار نيابة عن المشارك.

لأغراض هذا الإقرار، فإن "الحدث"يعني  حدث نادي NIKE التدريبي والذي قد أحضره/يحضره المشارك الآن أو في المستقبل في أي موقع وجميع وسائل المواصلات من وإلى مواقع تدريب نادي NIKE التدريبي وجميع فحوصات المنتجات خلال هذا الحدث وجميع الأنشطة الأخرى المرتبطة نادي NIKE التدريبي أو بمشاركتي/مشاركة المشارك في أي تدريب نادي NIKE التدريبي . وفي مقابل حصولي/حصول المشارك على فرصة المشاركة في هذا الحدث، فإنني أوافق/فان المشارك يوافق بموجبه ودون قيد أو شرط موافقة كاملة شاملة مطلقة لا رجوع فيها على ما يلي:

ASSUMPTION OF RISK: NIKE has made no representation to me/the Participant as to the suitability, condition, or safety of the Event venue and I/the Participant acknowledge(s) that participation in the Event may involve risks and dangers of accidents, personal and bodily injury and property loss or damage. I confirm that I/the Participant am/is in good health and have no medical or health condition that could endanger or limit my/the Participant's ability whilst participating in the Event.  I/the Participant understand(s) and have considered and evaluated the nature, scope and extent of the risks involved, and I/the Participant voluntarily and freely choose(s) to assume these risks. In addition, I agree to comply, or shall procure that the Participant complies, with the reasonable instructions of the Event leaders during the course of the Event.

افتراض المخاطر: إنّ NIKE لم تتعهد لي/للمشارك بأي شكل من الأشكال عن مدى ملاءمة أو حالة أو سلامة مكان الحدث وأقر/ويقر المشارك أن المشاركة في الحدث قد تنطوي على مخاطر أو أخطار قد تؤدي إلى حوادث أو إصابة شخصية وجسدية أو فقدان لممتلكات أو حدوث أضرار للممتلكات. وأؤكد أنني أتمتع/ أن المشارك يتمتع بصحة جيدة ولا أعاني/ يعاني من أي حالة طبية أو صحية يمكن أن تشكل خطرًا أو تحد من قدرتي/ قدرته أثناء المشاركة في الحدث. وأُدرِك/ويدرك المشارك وأخذت/ويأخذ بالاعتبار وقيَّمت/وقيّم طبيعة ونطاق ومدى المخاطر التي قد ينطوي عليها الحدث، وأتحمل/ويتحمل تلك المخاطر طواعية وبحرية. بالإضافة إلى ذلك، أوافق على الامتثال أو إلزام المشارك بالامتثال للتعليمات المعقولة التي تصدر عن القيمين على الحدث أثناء سير الحدث.

INSURANCE:  NIKE does not provide any insurance, whether life or medical or liability, for any illness, accident, injury, loss or damage that may arise in connection with my/the Participant’s participation in the Event.

التأمين: لا توفر NIKE أي تأمين سواء على الحياة أو تأمين طبي ولا تتحمل المسؤولية عن أي مرض أو حادث أو إصابة أو خسارة أو ضرر قد ينشأ عن مشاركتي/مشاركة المشارك في الحدث.

INDEMNITY: To the maximum extent permitted by applicable law, I/the Participant hereby fully, completely, irrevocably and unconditionally agree(s) to hold harmless and indemnify NIKE against, and reimburse NIKE for, any sum, cost, damage, loss, charge or expense (including reasonable legal fees) suffered by NIKE in connection with my/the Participant’s attendance at, or participation in the Event, including without limitation arising as a result of any claim due to any accident, loss or damage myself, or the Participant, may suffer.

التعويض عن الضرر: إلى الحد الأقصى الذي يسمح به القانون المعمول به، فإنني أوافق/يوافق المشارك بموجبه موافقة كاملة شاملة لا رجوع فيها ودون قيد أو شرط على عدم الإضرار بـ NIKE وتعويضها عن أية مبالغ أو تكاليف أو أضرار أو نفقات أو رسوم تتكبدها NIKE (بما في ذلك الأتعاب القانونية المعقولة) بسبب الحضور والمشاركة في الحدث، بما في ذلك، على سبيل المثال لا الحصر، ما ينشأ نتيجة أي مطالبة بسبب حادث أو خسارة أو ضرر قد أتعرض له أو قد يتعرض له المشارك.

LIABILITY:  To the maximum extent permissible under law, I/the Participant agree(s) that any liability of NIKE relating to my/the Participant's participation in the Event is excluded except in the case of NIKE's negligence or willful misconduct.

المسؤولية: لأقصى حد مسموح به بموجب القانون، أوافق/يوافق المشارك أن يتم إبراء NIKE من أية مسؤولية تتعلق بمشاركتي/مشاركة المشارك في الحدث إلا في حالة الإهمال أو سوء التصرف المتعمد من قبل NIKE.

FILM AND VIDEO RELEASE: I/the Participant acknowledge(s) and agree(s) that NIKE, its associates, affiliates, subsidiaries, licensees, agents, successors, assigns and commercial partners authorized by NIKE (collectively, “NIKE Group”), may be filming, photographing or otherwise recording my/the Participant's attendance at the Event and any related activities for advertising, promotional and/or for NIKE internal purposes.  I/the Participant hereby irrevocably grant(s) the NIKE Group the right to use, in perpetuity, throughout the world and without any compensation, any photograph, video, image, sound recording or other recorded media or likeness of me/the Participant, whether captured at the Event or during the associated activities (the "Materials") for the purpose of advertising, promotion, or any other commercial purpose in connection with the Event, in NIKE campaigns and/or for other NIKE promotional activities all over the world and without compensation. I/the Participant agree(s) that all right, title and interest in and to the Materials and all intellectual property rights as may exist in the Materials shall be owned by NIKE and shall be deemed to have been assigned by me/the Participant to NIKE automatically on their creation. I/the Participant waive(s) to the maximum extent permitted under Lebanese law, any and all moral rights, which myself, or the Participant, may have in relation to the Materials in any part of the world. I/the Participant also hereby grant(s) NIKE permission to display my/the Participant’s name, Event standings and results, in any media and in any manner now known or hereafter developed.

تسجيل الأفلام ومقاطع الفيديو: أقر/يقر وأوافق/ويوافق المشارك على حق NIKE وشركائها وشركاتها التابعة والفرعية والمرخص لهم ووكلائها وخلفائها والمتنازل لهم والشركاء التجاريين المرخص لهم من قبل NIKE (يُشار إليهم مجتمعين بـ"مجموعة NIKE") القيام بتصوير الأفلام أو التصوير الفوتوغرافي أو تسجيل حضوري أنا أو حضور المشارك في الحدث والأنشطة ذات الصلة وذلك لأغراض NIKE الدعائية أو الترويجية أو الداخلية. وأمنح/ويمنح المشارك بموجبه، بلا رجوع، مجموعة NIKE الحق في استخدام أي صورة أو فيديو أو تسجيل صوتي أو غيرها من الوسائط المسجلة سواء تم التقاطها خلال الحدث أو الأنشطة المرتبطة بالحدث ("المواد") لغرض الإعلان أو الترويج أو لأي غرض من الأغراض التجارية الأخرى المتعلقة بالحدث أو في حملات NIKE و/أو أنشطة NIKE الترويجية الأخرى وذلك في جميع أنحاء العالم ودون مقابل. وأوافق/ويوافق أيضاً على أن جميع حقوق ملكية المواد وحقوق الملكية الفكرية المرتبطة بهذه المواد محفوظة لـ NIKE وليس لي/للمشارك أي حق فيها. وأتنازل/ويتنازل المشارك عن أي حقوق تخصني/تخصه تتعلق بهذه المواد. وأقر بأنني أتنازل/بأنه يتنازل عن أي حقوق أدبية قد أملكها/يملكها بموجب القانون اللبناني في هذه المواد وفي أي مكان من العالم. كما إنني أمنح/يمنح المشارك بموجبه NIKE الحق في نشر اسمي أو اسم المشارك وترتيبات ونتائج الحدث في أي وسيلة إعلامية وبأي شكل من الأشكال المعروفة الآن أو التي تنشأ فيما بعد.

LICENSE TO USE COMMENTS, FEEDBACK AND IDEAS:  I/the Participant hereby grant(s) to NIKE a perpetual license to use all comments, feedback and ideas I/the Participant may share with NIKE Group without notice, compensation or acknowledgement to me/the Participant, for any purposes whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving existing products and services.

منح الحق في استخدام التعليقات والملاحظات التقييمية والأفكار: إنني أمنح/يمنح المشارك بموجبه NIKE وبشكل دائم الحق في استخدام جميع التعليقات والملاحظات التقييمية والأفكار التي قد قمت أنا أو المشارك بتقديمها إلى مجموعة NIKE، وذلك دون إشعار أو مقابل وبدون الحاجة إلى إذن مني أو من المشارك، ولأي أغراض أيًا كانت، بما في ذلك، على سبيل المثال لا الحصر، تطوير وتصنيع وتسويق المنتجات والخدمات الحالية وإنشاء وتعديل أو تحسين المنتجات والخدمات.

NIKE'S RIGHT TO REFUSE ENTRY: I/the Participant understand(s), acknowledge(s) and agree(s) that NIKE shall at all times be entitled to refuse my/the Participant's attendance at, and/or my/the Participant's participation in Event activities in the event I/the Participant do not comply with the terms of this release form or with the directions of NIKE Group staff or representatives at the Event.

حق NIKE في رفض المشاركة: أعي/يعي المشارك وأُدرِك/ويدرك وأوافق/ويوافق على أن NIKE لها الحق في جميع الأوقات أن تقوم برفض حضوري/حضور المشارك أو المشاركة في أنشطة الحدث في حال عدم التزامي أو التزام المشارك ببنود هذا الإقرار أو بتوجيهات موظفي أو ممثلي مجموعة NIKE أثناءالحدث.

PERSONAL DATA PROTECTION: I/the Participant understand(s) and agree(s) that in order to participate in the Event, I/the Participant am/is required to supply certain information about myself/the Participant in this release form and on the Event registration website. NIKE has specified which information is mandatory in order to participate in the Event.  I/the Participant understand(s) and agree(s) that my/the Participant's personal information will be used by NIKE for the purposes of administering the Event and for the specific purposes described in this release form. I/the Participant understand(s) and agree(s) that all personal information provided by me and/or by the Participant will be subject to the NIKE Privacy and Cookie Policy which can be found at http://help-en-gb.nike.com/app/answers/detail/article/privacy-policy/a_id/16415/p/3897 .

حماية البيانات الشخصية: أُدرِك/يدرك المشارك وأوافق/ويوافق على أنه من أجل المشاركة في الحدث يجب أن أقدم/يقدم المشارك معلومات معينة عن نفسي أو عن المشارك في هذه الاستمارة ومن خلال الموقع الإلكتروني للتسجيل في الحدث. وقد حددت NIKE ما هي المعلومات الإلزامية من أجل المشاركة في الحدث. وأُدرِك/ويدرك وأوافق/ويوافق على أنه سيتم استخدام المعلومات الشخصية الخاصة بي أو بالمشارك من قبل NIKE لأغراض إدارة الحدث وللأغراض المحددة الموضحة في نموذج الإقرار. وأُدرِك/ويدرك وأوافق/ويوافق على أن جميع المعلومات الشخصية المقدمة من قبلي و/أو من قبل المشارك ستخضع لسياسة NIKE المتعلقة بالخصوصية وملفات الارتباط، والتي يمكن الاطلاع عليها من خلال الرابط  http://help-en-gb.nike.com/app/answers/detail/article/privacy-policy/a_id/16415/p/3897

NON TRANSFERABLE: I understand that my/the Participant's entry in the Event is non-transferable and is not redeemable for cash.

عدم القابلية للتحويل: أُدرِك/يدرك المشارك أن المشاركة في الحدث غير قابل للتحويل للغير ولا يمكن استبداله بمقابل نقدي.

VALIDITY: If any clause of this release form is held, in part or in full, to be invalid or unenforceable for any reason, the validity of the remaining clauses of this release form shall not be affected, and they shall continue to be valid and enforceable. The invalid or unenforceable provision shall be replaced with a valid provision which is as similar as possible in substance to the invalid or unenforceable provision. This release form supersedes any oral or written agreement made previously in relation to the Event.

الصلاحية: إذا ثبت عدم صلاحية أي بند في هذا الإقرار، جزئيًا أو بالكامل، أو عدم قابليته للتنفيذ لأي سبب من الأسباب، فإن ذلك لا يؤثر على صلاحية البنود المتبقية من هذا الإقرار، وتظل صالحة وواجبة التنفيذ. ويجب أن يتم استبدال البند الباطل أو غير القابل للتنفيذ بآخر صالح يشبهه قدر الإمكان من حيث المضمون. ويحل هذا الإقرار محل أي اتفاق شفهي أو خطي صدر سابقاً فيما يتعلق بالحدث.

JURISDICTION AND INTERPRETATION: This release form and any disputes arising in connection thereto shall be governed by and construed in accordance with the laws of the Republic of Lebanon and shall be subject to the non-exclusive jurisdiction of the Courts of Beirut, Lebanon.

الاختصاص القضائي والتفسير: يخضع ويُفَسَّر هذا الإقرار وأي نزاع قد ينشأ فيما يتعلق به للقوانين المرعية الإجراء في الجمهورية اللبنانية ويخضع للاختصاص القضائي غير الحصري لمحاكم بيروت، لبنان.

PARENT/GUARDIAN AGREEMENT

موافقة الوالد/الوالدة/الوصي

أنا الوالد/الوالدة الذي له سلطة الأهل على أو الوصي القانوني للمشارك المذكور أعلاه وأوافق على مشاركته في الحدث بناء على الشروط الموضحة في هذا الإقرار. ونيابة عن المشارك وعن نفسي وعن أهالي أو أوصياء المشارك وورثته وتركته وشركات التأمين والمتنازل لهم وأي شخص آخر ممن يحق لهم رفع أي دعوى باسم المشارك أو نيابة عنه، أقر بموجبه كاملاً ودون قيد أو شرط أنني:

1. agree to all of the terms of this release form;

أولًا.     أوافق على جميع بنود هذا الإقرار؛

1. agree to remain the sole, direct and ultimate guardian responsible for the Participant and that such guardianship shall not transfer to any other person before, during or after the Event;

ثانياً.   أوافق على أن أبقى والوصي الوحيد والمباشر والمطلق المسؤول عن المشارك وأنّ وصايتي لن تنتقل إلى أي شخص آخر قبل الحدث أو خلالها أو بعدها؛

1. agree to cause the participant to comply with the terms of this release form; and

ثالثاً.   أوافق على إلزام المشارك بالتقيّد ببنود هذا الإقرار،

1. authorise and permit NIKE, its agents, and Event personnel to administer emergency first aid to the participant, emergency transportation, and any other emergency medical treatment performed by doctors, paramedics, and other medical personnel (including for the avoidance of doubt any medical test and/or trials) in the event of any accident or injury to the participant that may occur during and/or as a consequence of his or her participation in the Event.

رابعاً.   أُخوِّل وأسمح لـ NIKE، ووكلائها، والعاملين في الحدث بتقديم الإسعافات الأولية الطارئة للمشارك ونقله في حالات الطوارئ وإجراء أي معالجة طبية طارئة أخرى يقوم بها الأطباء والمسعفون وغيرهم من المختصين الطبيين (بما في ذلك تجنبًا للشك أي اختبار أو تجارب طبية) في حال وقوع أي حادث أو إصابة للمشارك أثناء الحدث أو بسببها.

I AM THE PARENT WHO HAS PARENTAL AUTHORITY OR THE LEGAL GUARDIAN OF THE BELOW NAMED PARTICIPANT WHO IS AGED UNDER 18 OR IS AGED 18 OR ABOVE BUT INCAPACITATED AND I HAVE READ THIS RELEASE FORM CAREFULLY, FULLY UNDERSTAND ITS CONTENT, AND VOLUNTARILY AGREE TO THESE TERMS ON BEHALF OF THE PARTICIPANT.

أنا الوالد/الوالدة الذي له سلطة الأهل أو الوصي القانوني للمشارك المذكور أعلاه الذي يقل عمره عن 18 عامًا أو أتم سن 18 عاماً وإنّما عاجز وقد قرأت هذا الإقرار الذي ورد أعلاه بعناية، وفهمت محتواه تمامًا، وأوافق طواعية على هذه الشروط نيابة عن المشارك.
