With this survey, Nike wants to understand Member engagement and sentiment towards the Nike Membership programme (to optimise future benefit programming).

If you wish to share your thoughts and participate in our research, please read carefully and agree to the terms below.

SURVEY TERMS and CONDITIONS

1. Nike Retail B.V. (“NIKE”) or another member of the “NIKE Group” (meaning Nike Inc., NIKE, its subsidiaries, any company or entity to which NIKE or any of its subsidiaries licenses rights or provides services to, and/or any company which is, in relation to any such company, its parent undertaking or subsidiary) is running a consumer research survey, in which you wish to take part.
2. You grant to NIKE a perpetual licence to use all comments, feedback and ideas that you may share with NIKE, without compensation or acknowledgement to you, for any purposes whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving products and services.
3. You understand and acknowledge that completing the consumer research survey does not and will not give you any rights whatsoever in the products and inventions that may be created or developed by NIKE as a result of that research. Therefore, you agree to assign to NIKE all rights, title and interest you may have, or may develop, in and to the ideas, products and inventions that are discussed during or created or developed in connection with or as a result of that research.
4. You warrant that: (i) you are 18 years old or older, (ii) you do not need to obtain permission from or pay any third party in connection with the rights granted in this agreement; (iii) you are entitled to grant the rights set out in this agreement; and (iv) it is not necessary for NIKE to obtain permission from or to pay any third party in connection with the rights granted in this agreement.
5. You understand and acknowledge that NIKE may request information from you in various formats including verbally or by e-mail. I understand that any follow-up communication is considered a part of the survey and is subject to all provisions of this agreement.
6. Responses to this survey will be associated with your NIKE account, and NIKE will use this information for research and analytics purposes, including to improve NIKE’s products and services.  For more information about how NIKE processes your personal data and the choices available to you, please review the Data Protection Notice below.
7. This agreement constitutes the entire agreement between us and supersedes and extinguishes all previous drafts, agreements, arrangements and understandings between us, whether written or oral, relating to its subject matter. This agreement cannot be altered or modified. Each party agrees that it shall have no remedies in respect of any representation or warranty (whether made innocently or negligently) that is not set out in this agreement.
8. If any wording in this agreement is held, in part or in full, to be invalid or unenforceable for any reason, the validity of the remaining provisions of this agreement shall not be affected, and they shall continue to be valid and enforceable. The invalid or unenforceable provision shall be replaced with a valid provision which is as similar as possible in substance to the invalid or unenforceable provision.
9. This agreement and any disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of the jurisdiction of the Participant’s residence.

DATA PROTECTION NOTICE

For the purposes of these terms, the data controller is the NIKE entity referenced above. By taking part in the survey, you will provide NIKE with certain personal data, such as contact details, opinions and personal details associated with the survey. You understand and acknowledge that by entering the survey and clicking “continue” to state that you agree with this Data Protection Notice, you give consent for NIKE to process your personal data. NIKE processes the personal data to administer and execute the survey, as well as to use the opinions you provide to inform NIKE’s business strategy and handle follow-up matters after the focus group has taken place.

You can withdraw your consent at any time. If you do this, NIKE will no longer be able to process your personal data and as a result you will no longer being able to take part in the survey. NIKE may share your personal data with third parties to process the data on NIKE’s behalf. When using third parties to process data, NIKE will require the third parties to implement appropriate measures to protect your personal data. NIKE may transfer or store the personal data collected and processed as part of the focus group outside of the EEA or Switzerland. When doing so, NIKE will ensure that your personal data transferred to these countries receives adequate protection in accordance with data protection rules.

NIKE will process your personal data at all times in accordance with applicable data protection legislation.
