Nike Eventurf Privacy Policy 

Effective Date: September 1, 2021 

Nike, Inc., located at Bowerman Drive 1, Beaverton, OR 97005, USA, and its subsidiaries and affiliates (for employees this includes the Nike entity by which you are employed, and referred to as “Nike”, “we”, “our” or “us” in this policy) is responsible for the processing of your personal data obtained through your use of the Nike Eventurf website or mobile application (hereafter: the "Platform"). 

Applicability: This policy applies to the Platform provided by Nike for event scheduling.  For Nike employees, further information about the personal information collected by Nike in the course of your employment relationship can be found in the Employee Privacy Policy applicable in your region, which is available on the policies section of this Platform.  

PERSONAL DATA

Information we collect from you.  We collect certain personal information from you on the Platform to enable the experience. 

This personal data may include: 

  • Contact details including name, email, telephone number;
  • Information about the event you registered for, including registration type, group, track, and session;
  • Your role/job title, department, team organization, office/work location and company;
  • Profile picture; or
  • Sizing information. 

Information we collect automatically. When you use the Platform, we collect some information automatically, as further described in the section below “Cookies and Similar Technologies.” For example: 

  • Identifiers and device information. When you visit the Platform, our web servers automatically log your Internet Protocol (IP) address (and associated location information) and information about your device, including device identifiers (such as MAC address); device type; and your device’s operating system, browser, and other software including type, version, language, settings, and configuration. As further described in the Cookies and Similar Technologies section below, our websites and online services store and retrieve cookie identifiers, mobile IDs, and other data. 
  • Usage data. We automatically log your activity on the Platform, including the URL of the website from which you came to the Website, pages you viewed, access times, and other details about your actions on the Website.    

HOW WE USE YOUR PERSONAL DATA 

We will process your personal data to operate the Platform and to carry out the purposes for which you provided the personal data, such as displaying your profile information and information regarding upcoming events, communicating relevant information (such as registration confirmation, agenda tracking, event status updates and real-time event updates), or connecting you to other services platforms provided to you by Nike. We will also use your personal data to identify opportunities for improvement of the functionality of the Platform. 

LEGAL GROUNDS 

To process your personal data, we rely on certain legal grounds, depending on how you interact with our Platform: 

  • When you use our Platform, we need your personal data to fulfill our agreement with you.
  • When you register for an event, we may also rely on your consent for processing your personal data,  
  • We also rely on other legal grounds, such as our legitimate interests as a business, in order to protect our services, maintain a trusted environment, and communicatie with you.
  •  In other cases, we may be required to process your personal data to comply with a legal obligation. 

COOKIES AND SIMILAR TECHNOLOGIES 

When you visit and interact with the Platform, certain data is collected from your device through the use of cookies. The data collected through cookies includes: (i) the visited webpages, (ii) date, time and duration of the visit, and (iii) unique device identifier and device type (desktop, tablet or smartphone). 

There are generally two categories of cookies used on the Platform:

  • Analytical cookies that are used to collect information about the date and time of your visit, the duration of your visit and the pages you visit. This information is used to better understand the use of the Platform and to improve the Platform.
  • Functional cookies that are used to collect information about the type of device you are using to visit the Platform. This information is strictly necessary to offer you the basic functionality of the Platform.

We do not use cookies on the Platform for advertising purposes.

You can choose to have your device or browser limit or disable the use of cookies. You can do this through your browser settings on each browser and device that you use. Each browser is different, so look at your browser Help menu to learn the correct way to modify your cookies. If you turn cookies off, you may not have access to features that make the Platform more efficient and some of the features of the Platform may not function properly.

SHARING PERSONAL DATA 

The personal data we obtain through the Platform will be shared with third parties to enable them to carry out services or other tasks on our behalf (e.g. hosting and platform providers or providers that analyze data on our behalf). These third parties process your personal data only on our behalf for the purposes mentioned in this Policy. Some of the data recipients with whom we share your personal data may be located in countries other than the country in which your personal data originally was collected. The laws in those countries may not provide the same level of data protection compared to the country in which you initially provided your data. Nevertheless, when we transfer your personal data to other countries, we will protect that personal data in accordance with this policy and in compliance with applicable law. We use a variety of measures to ensure that your personal data transferred to these countries receives adequate protection in accordance with data protection rules; this includes signing the EU Standard Contractual Clauses. Where personal data is transferred within Nike, we use an intragroup data transfer agreement.

We may also transfer personal data we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, spin-off, dissolution or liquidation).

We may disclose specific information upon governmental request, in response to a court order, when required by law or to protect our or others' rights, property or safety. We may share information to prevent illegal uses of the Platform or violations of the applicable Terms of Use, or defend ourselves against third party claims. We do not provide your personal data to agencies or outside companies for marketing purposes.

CONFIDENTIALITY AND PROTECTION 

The Platform uses a range of security technologies and procedures to protect your personal data against unauthorized access, use and disclosure. The personal data that the Platform gathers is stored in a secure environment that is inaccessible to the public. Despite our efforts, no website, mobile application, database or system is completely secure or “hacker proof.” You can help keep your data safe by taking reasonable steps to protect your personal information against unauthorized disclosure or misuse.  

STORAGE AND RETENTION OF YOUR PERSONAL DATA 

The personal data we collect via the Platform will be stored in the USA and other countries.

We retain your personal data for as long as necessary to fulfil the purposes described in this policy, unless otherwise required or permitted by law. 

LINKS TO OTHER WEBSITES 

The Platform may provide links to other websites for your convenience and information.  These websites may operate independently from us and may have their own privacy notices or policies, which we strongly suggest you review.  To the extent any linked websites are not owned or controlled by us, we are not responsible for their content, any use of the websites, or the privacy practices of the websites. 

YOUR PERSONAL DATA RIGHTS 

You may have certain rights in relation to your personal data, depending on your relationship with Nike and your location. This includes the right to request: (i) access to your personal data; (ii) an electronic copy of your personal data (data portability); (iii) correction of your personal data if it is incomplete or inaccurate; (iv) deletion of your personal data in certain circumstances provided by applicable law; (v) restriction the use of your personal data in certain circumstances provided by law, such as while we consider another request that you have submitted; (vi) objection to the processing of your personal data on grounds relating to your particular situation; or (vii) withdrawal your consent, if you have previously consented. Finally, you may have a right to not be discriminated against for exercising these rights. Note that these rights are not absolute, and there may be exceptions that apply to specific requests to exercise them. You may also lodge a complaint with the relevant supervisory authority in the country in which you reside.

CHANGES TO OUR PRIVACY POLICY 

If we decide to change our privacy policy, we will post the changed policy on the Platform. You are advised to regularly check whether our privacy policy has changed. If we materially change the way in which we process your personal data, we will provide you with prior notice, or where legally required, request your consent or ensure that there is another legal basis for such processing, prior to implementing such changes. 

This policy was last modified in September 2021.
